Please read these Terms of Service carefully before using StarCards™. By accessing or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.

Note: These terms are a working draft and will be reviewed by legal counsel prior to the public launch of StarCards.

1. The Service

StarCards™ is a personal productivity and journaling application that allows users to create daily cards, track tasks, record memories, and view personal statistics. The service is provided by StarCards LLC, a Nebraska limited liability company (“we,” “us,” or “our”).

2. Accounts

You must create an account to use StarCards. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.

You must be at least 14 years old to create an account. By registering, you represent that you meet this age requirement.

3. Subscriptions and Billing

Some features of StarCards require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select). You authorize us to charge your payment method on each billing date.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; we do not provide prorated refunds for unused time within a billing period, except where required by applicable law.

We reserve the right to change subscription pricing with reasonable advance notice. Continued use of the service after a price change constitutes your acceptance of the new pricing.

4. Your Content

You retain full ownership of the content you create in StarCards — your cards, notes, tasks, and memories are yours. By using the service, you grant us a limited license to store and display your content solely for the purpose of providing the service to you. We will never use your content for any other purpose.

You are responsible for ensuring that your use of the service and the content you submit does not violate any applicable laws or third-party rights.

5. Acceptable Use

You agree not to use StarCards to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property rights of others.
  • Transmit harmful, harassing, defamatory, or otherwise objectionable content.
  • Attempt to gain unauthorized access to any part of the service or its underlying systems.
  • Interfere with or disrupt the integrity or performance of the service.
  • Use automated means (bots, scrapers) to access the service without our written permission.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

6. Intellectual Property

StarCards™ and its original design, features, and functionality are and will remain the exclusive property of StarCards LLC. The StarCards name and logo are trademarks of StarCards LLC. Nothing in these terms grants you a right to use our trademarks, trade names, or logos.

7. Privacy

Our Privacy Policy describes how we collect and use your information. By using StarCards, you agree to the collection and use of information as described therein.

8. Service Availability

We strive to maintain reliable uptime, but we cannot guarantee that the service will be available 100% of the time. We reserve the right to modify, suspend, or discontinue the service (or any part of it) at any time, with reasonable advance notice where possible. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STARCARDS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless StarCards LLC from any claims, losses, damages, liabilities, and expenses (including reasonable attorney’s fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

12. Governing Law

These terms are governed by the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Nebraska.

13. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email and update the “Last Updated” date at the top of this page. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
